It has come to pass that the federal government and states have finally succeeded in getting a cell phone usage law passed. So as to make sure that you understand the ramifications of this law lets talk about all the possibilities.

Now according to what has been printed so far. If a driver is not using a hands free cell phone system they will be in violation of this new law or regulation, depending on where and who stops you.

But the bottom line here is that in any case the enforcement is up to the officer's opinion of whether or not the driver is violating the law.

In case you don't understand! If the driver is holding the phone to dial, he would be in violation of the cell phone law. If the driver is on his off time and is holding the phone or dialing the phone while in the truck, he is in violation.

The driver will be fined up to $2,750 and the carrier will be fined up to $11,000. If there is a second offense by the driver of the cell phone law the fines are doubled and the driver is suspended for six months.

Now a driver and the carrier will have the opportunity to fight these citations in court but it will be a very expensive proposition. Drivers must have availability to legal services in every state they drive in. Why? Because every attorney will not be versed in this trucking law and if a driver cannot find a trucking law attorney in Podunk America he is much more likely to lose the case. A legal case no driver can afford to lose.

Now, about this time in my story you may be thinking this is some sort of sales pitch. Well, it isn't! If your smart and you can understand how this new law can impact both you and your carrier go find you some legal protection that you will be comfortable with.

If you're afraid you are being sold a pig in a blanket then wait until you face this situation. Of course you will stand a good chance of being taken advantage of by every bad lawyer in the country. Only God knows where you will be when this happens to you!
